Obligations of Employer

The employer, must:

  • Provide the caregiver with the written contract clearly identifying duties of the caregiver
  • Comply with the Labor regulations
  • Provide the caregiver with:
  1. Private furnished bedroom with lock within employers home
  2. Health insurance until he/she becomes eligible for provincial health insurance.
  3. workplace safety insurance (also known as workers’ compensation) or equivalent insurance if the former is not available
  4. One way ticket from the caregiver’s place of residence
  5. Record of Employment (ROE)
  • Keep records of the number of regular and overtime hours the live-in caregiver worked on a weekly/monthly basis.
  • Remit taxes.
  • Review and adjust the foreign caregiver's wages to ensure they meet or exceed HRSDC's requirements (as per HRSDC's Wages table).
  • Ensure that they are not employing a foreign national other than in a capacity they are authorized to work.
  • Ensure that they are not employing a live-in caregiver without a valid work permit identifying them specifically as the employer.

The employer, cannot:

  • Ask the caregiver to work more hours than is specified in her contract without compensation
  • Force the caregiver to perform duties which are not part of the contract
  • Keep the caregiver on call 24 hours
  • Enter the  caregiver’s room without permission
  • Keep the caregiver’s work permit, passport or any other documents
  • Deport the caregiver from Canada
  • Share the caregiver with other Family
  • Change conditions of the contract without a written agreement of the Caregiver
  • Recoup any of the costs related to the recruitment or travel from the Caregiver.
